Petitioner alleged that NYCHA violated NYCCBL ยง 12-306(a)(1) and (3) by terminating her in retaliation for having sought union assistance regarding a counseling memorandum and a denied leave request. NYCHA argued that Petitioner has failed to establish a prima facie case of retaliation and that the decision to terminate her was based on legitimate business reasons. The Board found that although Petitioner established a prima facie case of retaliation, NYCHA demonstrated legitimate business reasons for her termination. Accordingly, the petition was denied.
